النهر الفائق'Umar Ibn Nujaym

(وإن فتات) أي: الصيد (فعليه الجزاء) لأن رد البيع لوجوب إرساله فإن تعذر نزل منزلة إتلافه كذا في (البدائع) قيل: وهذا أولى ص قول صاحب (الهداية) لأنه تعرض للصيد بتفويت الأمن الذي استحقه لما روي من أن البيع ليس بتعريض له حسًا بل حكمًا.
