(فإن تعذَّرا) أي: حِرْز مثلها وما فوقه، عند غشيان ما الغالب منه الهلاك (وأحرزها) الوديع (في دونه) في هذه الحال (فلا ضمان) على الوديع؛ لأن إحرازها به إذًا أحفظ لها مِن تَرْكها بمكانها، وليس في وسعه حينئذ سواه.
