(فإن اختلفا فيها) أي: في قيمة رأس مال السَّلَم الباطل، أو في قَدْر الصُّبرة المجعولة رأس مال سَلَم (فقول مسلَمٍ إليه) بيمينه؛ لأنه غارم.
