(وإن كان) الزوج (قادرًا على أدائه) أي: أداء ما حبسته عليه من حقوقها (فمنعه بعد الطلب، فلها النفقة مدة حبسه إذا كانت باذلة للتمكين؛ قاله الشيخ (٢) ) لأن المنع منه لا منها.
