(فلو قطع من له خمسُ أصابعَ يدَ من له أربع) أصابع فأقل (أو قطع من له أربعُ) أصابعَ (يدَ من له ثلاث) أصابعَ فأقل؛ فلا قِصاص؛ لعدم المساواة (أو قطع ذو اليد الكاملة يدًا فيها إصبعٌ شلَّاءُ فلا قِصاص) لعدم المساواة.
